Separating Myths from Reality: What Communities Must Know!
Rumors about immigration policies and enforcement are creating fear and spreading misinformation. We must stay informed through trusted and reliable sources. Let’s break down what is true at this point. This administration is counting on us not knowing, using, or defending our rights, but knowing our rights is our first line of defense.
Information is Power. Know Your Rights.
Question: “ICE can detain me in a public place without a warrant.”
What we’ve seen in Oregon is arrests happening in public spaces. But remember: we all have the right to remain silent and to ask if we are free to leave.
Question: “ICE can enter my vehicle without a warrant, even if I haven’t committed a crime.” (False)
ICE cannot legally enter your vehicle without your permission, a judicial warrant signed by a judge, or probable cause that a crime is being committed. You have the right not to open the door and not to answer any questions without a lawyer present.
The 4th Amendment of the U.S. The Constitution protects you from arbitrary searches and seizures by the government. This means that ICE and other law enforcement agencies cannot search you, your home, or your vehicle without a judicial warrant, your consent, or probable cause.
Question: “Birthright citizenship is no longer valid.” (False)
The 14th Amendment of the U.S. The Constitution guarantees that anyone born in the United States is a U.S. citizen. That means your children born in the U.S. are citizens with full rights. No law has changed this protection as of now.
Question: “There are bounty hunters working with ICE.” (False)
Bounty hunters only operate in criminal bail cases—not in immigration enforcement. Immigration matters are civil cases, not criminal ones. You have the right to ask any officer to identify themselves and state which agency they work for.
Question: “Public agencies can share your personal information with ICE.” (False)
State and local government agencies, including law enforcement, should not collect, store, or share information about your country of birth, immigration status, or citizenship. If you suspect a violation of Oregon’s Sanctuary Laws, call the Sanctuary Promise Hotline at 1-844-924-7829.
Question: “They can freeze your bank account if you don’t have papers.” (False)
Your immigration status is not a legal reason to freeze your bank account. Don’t react based on rumors—make sure you get reliable information from someone who can guide you. To confiscate or freeze funds, the government must have a court order related to a crime (such as fraud or money laundering).
These are just some myths vs. realities, but there are more. Stay informed and go through a series of steps before sharing, as spreading inaccurate information can misguide our communities.
