Las órdenes judiciales y administrativas son dos tipos órdenes diferentes qué se confunden al hablar de ICE (Immigration Custom Enforcement).

Este recurso explica la diferencia entre estas dos tipos de ordenes, lo qué debe incluir una orden de arresto válida y frases para ayudarle practicar ejercer sus derechos.

Una orden judicial es una orden oficial administrada por una corte, firmada por un juez o magistrado que autoriza revisar una propiedad privada, confiscar bienes o hacer un arresto, con base en una causa probable de que se está cometiendo o se ha cometido un delito.

What is a Judicial Warrant?

A judicial warrant is an official court order signed by a judge or magistrate that authorizes a search of private property, seizure, or arrest based on probable cause that a crime is being committed or has been committed.

¿Qué la hace válida?

Tres cosas claves que contiene una orden judicial válida:

En la parte superior de la orden debe aparecer la palabra “COURT”, lo que indica que fue emitida por una corte.
La order debe estar dirigida a la persona correcta.
La orden debe estar firmada por un juez o magistrado, entonces busqué la palabra “JUDGE”.

Si un oficial dice que tiene una orden, pídale que le muestre la copia física. No abra la puerta. Pida que el oficial deslice la orden por debajo de la puerta, se la enseñe por la ventana o frente a su cámara.

What makes it valid?

Three key things a valid judicial warrant must have:

The top of the judicial warrant should include the word “COURT”, meaning it is issued by a court.
The warrant should be addressed to the correct person.
The warrant must be signed by a judge or magistrate, so look for the word “JUDGE”.

If an officer says they have a warrant, ask them to show you the physical copy. Do not open the door, have the officer slide the warrant under the door, show it to you through the window, or in front of your camera.

Una orden administrativa no es una orden judicial. Las órdenes administrativas de ICE no otorgan a los oficiales de ICE la autoridad para ingresar a un lugar donde exista una expectativa razonable de privacidad, sin consentimiento.

Si esto ocurre, indique claramente que no da su consentimiento para que ingresen, pero no se resista físicamente. Sin una orden judicial firmada por un juez, ICE no tiene permitido entrar ni registrar su hogar.

An ICE administrative warrant is not a judicial warrant. ICE administrative warrants do not give ICE officials authority to enter a place where there is a reasonable expectation of privacy, without consent. If this happens, state clearly that you do not consent to them entering but do not physically resist.

¡Maneras de Ejercer sus Derechos!

Sin una orden judicial firmada por un juez, ICE no tienen permiso de registrar ni entrar a su hogar.

Por lo general, ICE no tendrá una orden, pero podrían mentir y decir que sí la tienen, o mostrarle algún documento que parezca oficial. Por eso, revise con cuidado y tome fotos de cualquier documento que le muestren. También es importante que no abra la puerta (manténgala cerrada).

Si se niegan a mostrarle estos documentos, sin una orden judicial firmada por un juez, ICE no tiene permiso de registrar ni entrar a su hogar.

No le muestre nada ni diga nada a los agentes. ICE no siempre va a obedecer y podría entrar a su hogar usando violencia. Pero usar las siguientes frases le pueden ayudarle en la corte, incluso si los agentes violan sus derechos.

Ways to Exercise Your Rights!

Without a warrant, signed by a judge, ICE is not allowed to enter or search your home.

ICE usually won't have a warrant, but they may lie and say they do, or show you something else that looks official. So review everything carefully and take photos of anything they show you. It’s also important that you do not open the door (keep it closed at all times).

If they refuse to show you these documents, then without a judicial warrant signed by a judge, ICE does not have permission to search or enter your home.

Do not show the agents anything or say anything. ICE won't always listen to you and may enter your home using force. But saying the following phrases might help you in court, more so if the agents violate your rights.

Si los oficiales están en su puerta NO ABRA LA PUERTA:

“¿Tiene una orden firmada por un juez?”
“No abriré la puerta a menos que me muestre una orden.”
“Por favor, deslice la orden por debajo de la puerta.”

If officers are at your door DO NOT OPEN THE DOOR:

“Do you have a warrant signed by a judge?”
“I will not open the door unless you show me a warrant.”
“Please slide the warrant under the door.”

Si los oficiales piden registrar su persona, su carro o su casa:

“No doy mi consentimiento para que registren.”
“No les doy permiso para hacer un registro.”
“Estoy ejerciendo mi derecho de la Cuarta Enmienda y no doy mi consentimiento para ningún registro.”

If officers ask to search your person, your car, or your home:

“I do not consent to a search.”
“I do not give you permission to search.”
“I’m exercising my 4th Amendment right and do not consent to any searches.”

Si lo detienen en público:

“¿Estoy detenido o soy libre de irme?”
“No doy mi consentimiento para que registren mis pertenencias.”
“No quiero responder ninguna pregunta. Es mi derecho permanecer en silencio.”

If you are detained in public:

“Am I being detained, or am I free to go?”
“I do not consent to a search of my belongings.”
“I do not want to answer any questions. It is my right to remain silent”
